203 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-24360-2026 Date of Decision: 28.07.2026 Peter …Petitioner vs. State of Punjab …Respondent
Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Ms. Gagan Bir Kaur Kahlon, Advocate, for the petitioner. Mr. Amit Rana, Sr. DAG, Punjab. *** N.S.Shekhawat J. (Oral)
1. The petitioner has filed the present petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 438 Cr.P.C.) for grant of anticipatory bail to him in case FIR No.30 dated 07.03.2026, registered under Sections 115(2), 118(1), 118(2) and 191(3) of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Sections 323, 324, 326, 148 and 149 IPC), at Police Station Qadian, Police District Batala, District Gurdaspur, Punjab. It is further stated that offence under Section 118(2) BNS (corresponding to Section 326 IPC) was added subsequently during investigation.
2. While granting the concession of interim anticipatory bail by a Co- ordinate Bench of this Court on 19.05.2026, the following contentions were noticed by this Court and the same have been reproduced below:-
“Learned counsel for the petitioner contends that the petitioner is innocent and has been falsely implicated on the basis of the statement of complainant Baljit Kaur. As per the FIR, the alleged incident occurred on 04.03.2026 during a dispute in which both sides sustained injuries. The petitioner is alleged to have caused an injury on the complainant's right wrist with a dattar. HEMLATA 2026.07.28 16:41 I attest to the accuracy and integrity of this document
CRM-M-24360-2026 -2- Subsequently, Section 118(2) BNS (Section 326 IPC) was added after the injury was declared grievous, though it is on a non-vital part and there is a delay of three days in lodging the FIR. It is further submitted that the case is one of version and cross-version, as both parties sustained injuries in the same occurrence. The petitioner also suffered injuries, and Jaswinder Kaur sustained multiple injuries, including one declared grievous, indicating mutual fight. The petitioner further submits that the complainant party allegedly entered the house of Jaswinder Kaur and attempted to outrage her modesty, making it a matter of trial as to who was the aggressor. The petitioner had earlier filed an anticipatory bail application before the learned Sessions Judge, Gurdaspur, which was dismissed on 16.04.2026. Learned counsel submits that the petitioner is still ready and willing to join investigation and to fully cooperate with the Investigating Agency.”
3.
Learned counsel for the petitioner has reiterated the submissions and further submits that the petitioner has joined the investigation and his custodial interrogation may not be required.
4. Learned State counsel submits that the petitioner has joined the investigation and is no longer required for further investigation.
5. In view of the statement made by learned counsel for the parties, the present petition is allowed and the interim order dated 19.05.2026, passed by a Co-ordinate Bench of this Court is made absolute. The petitioner shall continue to join investigation, as and when called by the Investigating Officer and shall also abide by the conditions as provided under Section 482(2) of the BNSS.
