By filing this revisional application, the petitioners pray for quashing of proceedings being GR Case no. 3012 of 2011, now pending before the learned Additional Chief Judicial Magistrate, Sealdah arising out of Cossipore Police Station Case No.. 213/2011 dated 24.10.2011 under Sections 304A/34 of the Indian Penal Code. 2. Mr. Sandipan Ganguly, learned senior counsel appearing on behalf of the petitioners submits that in the instant case, chargesheet has already been submitted. Therefore, he prays for withdrawal of the instant revisional application seeking liberty to ventilate the petitioners’ grievances before the learned Court below at the time of framing charge. 3. Prayer is allowed. 2 4. The petitioners shall be at liberty to ventilate the grievance before the learned Court below in accordance with law. 5. Accordingly, CRR 4098 of 2012 is dismissed as withdrawn. 6. Consequently, the connected application being CRAN 21/2026 is, thus, disposed of. 7. However, the dismissal of the instant revisional application would not preclude raising all points before the Trial Court, as this Court does not have the opportunity to enter into the merit of the case. 8. Interim order, if any, stands vacated. 9. Let the order be communicated to the Ld. Court below for information. 10. All parties shall act in terms of the copy of this order duly downloaded from the official website of this court. 11.
