Document has been submitted by the learned advocate appearing for the defacto-complainant. It is submitted that there was a previous dispute which has been settled. Having considered the change of circumstances, without entering into the merits of the case, I am inclined to enlarge the petitioners on anticipatory bail. Hence, the prayer for anticipatory bail of the petitioners is Allowed.
2 Accordingly, I direct that in the event of arrest, the petitioners [Mrinal Kanti Singha and Rumki Modak @ Rumki Modak Singha] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner no.1 shall meet with the Investigating Officer of the case within ten days from date, thereafter, on all subsequent dates as would be fixed by the I.O. of this case. So far as the petitioner no.2 is concerned, she would make herself physically available as and when she would be required by the I.O. of this case. Accordingly, CRM (A) 1719 of 2026 is disposed of. Documents submitted by the defacto-complainant be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
