Heard Mr. M. Mahanta, learned counsel for the applicant and Ms. A. Gayan, learned CGC. Also heard Mr. H.K. Hazarika, learned Government Advocate; Mr. G. Sarma, learned standing counsel for the FT matters and NRC; Ms. S. Katakey, learned standing counsel for the ECI.
2. By filing this interlocutory application, it is submitted that a typing error has occurred in paragraph Nos. 3, 4 and 7 of the order dated 13.06.2025 wherein instead of ‘Exhibit-F’, reference is made to ‘Exhibit-5’.
3. It is also submitted that in paragraph- 7 of the said order, the Court granted leave to the applicant to move an appropriate application in connection with Exhibit-5 affidavit. However, there is an omission of the word ‘not’ in the
Page No.# 3/3 said directions which changed the context of the lift given in said paragraph-7 of the order.
4. Having seen Annexure-6 of the connected writ petition i.e. WP(C)/ 3177/2025, it is seen that an error in typing, as pointed out has crept in the
order dated 13.06.2025.
5. Accordingly, the reference to Exhibit-5, appearing in paragraph Nos. 3, 4 and 7 in the order dated 13.06.2025, passed in WP(C)/ 3177/2025, shall now be read as Exhibit-F.
6. As the omission of the word ‘not’ is apparent in paragraph-7 of the said
order, the recast paragraph- 7 of the order dated 13.06.2025 shall now read as follows:
“7. Accordingly, the Court is inclined to provide that the said order dated 19.03.2025, passed by the learned Member, Foreigners Tribunal No.5, Kamrup (Metro), Guwahati shall not be a bar for the petitioner to move an appropriate application in respect of the Ext.5, affidavit, in a manner in which the petitioner may be so advised.”
7. Accordingly, this interlocutory application stands disposed of.
8. This order shall be read together with the order dated 13.06.2025 passed in WP(C)/ 3177/2025.
