The petitioner is before this Court seeking for the following reliefs: (i) Issue a writ of Mandamus directing the Respondent to release/pay balance sale proceeds from the auction amounting to Rs.11,99,207/- which has been realized from the auction of the Petitioner's timber and billets to the Petitioner, by considering the representation dated 24.07.2026 as per ANNEXURE-A. (ii) Issue any other writ or order or direction that deems fit to grants in the circumstances of the case in the interest of justice and equity. 3. The petitioner claims to be the owner of the land bearing Sy.No.55/10 measuring 07 acres situated at Hosuru Village, Ammati Hobli, Virajpet Taluk, Kodagu District. The petitioner who applied for permission to cut trees was so granted and thereafter the trees were cut and sold. The petitioner had sought for making payment of the auction amount which was not so paid. Hence, representation has been submitted by the petitioner on - 4 - HC-KAR CNR: KAHC010543052026 NC: 2026:KHC:43273 WP No. 24894 of 2026 24.07.2026, which the petitioner claim has not been acted upon. Though said representation has been submitted on 24.07.2026 instead of dismissing the above petition, this Court is of the considered opinion that the respondent to be directed to consider the representation and pass necessary orders within a period of three months from the date of receipt of copy of this order. 4. In that view of the matter, this Court passes the following: ORDER (i) The writ petition is partly allowed; (ii) The respondent is directed to consider the representation of the petitioner dated 24.07.2026 at Annexure-A and pass necessary orders within a period of 90 days from the date of receipt of copy of this order.
