Affidavit-of-service filed in Court today is taken on record. 2. The petitioner is aggrieved that the reasoned order passed by the Director of Health Services, Government of West Bengal dated May 15, 2023 has wrongly rejected his application for enhancement of his remuneration as he was unable to procure and provide the requisite documents in support of his prayer. 3. The petitioner had joined the post of Peon-cum-Night Guard on a contractual basis at the office of the Assistant Chief Medical Officer (Health), Egra on February 2, 2009. He sought for enhancement of his remuneration and had approached the West Bengal Administrative Tribunal which had directed the Director of Health Services, Government of West Bengal to consider the case of the petitioner. 4. The Director of Health Services has duly considered the same and has rightly rejected the claim of the petitioner for enhancement of remuneration as he was unable to provide the requisite documents. The requisite documents required for any consideration is a certificate of continuity of service by an 2 Assistant Secretary in the case of a Secretariat department or Director in the case of a Directorate. 5. The petitioner is employed in a Directorate. The requisite certificate ought to be issued by the Director of Health Services, Government of West Bengal. 6. The Director of Health Services in the impugned order has granted liberty to the petitioner to obtain necessary documents and reapply for enhancement of the remuneration. 7. The petitioner is at liberty to apply before the concerned authority and if so applied, the said authority will forward his recommendation to the Director of Health Services, Government of West Bengal, who will then proceed to issue the certificate, if the petitioner is found to be otherwise eligible. The impugned order cannot be faulted on any ground and is not interfered with. If the petitioner is able to substantiate his claim by way of sufficient and qualified documents, his claim shall be reconsidered by the authorities. 8. With the afore-stated directions, WPA 16489 of 2026 is disposed of. 9. There shall be no order as to costs. 10. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
