Mr. Satadru Lahiri Mr. Ashis Kumar Mukherjee Mr. Saurabh Prasad …for the petitioner This revisional application has been filed seeking expeditious disposal of Complaint Case No. 470 of 2023 pending before the Court of the learned Judicial Magistrate, 3rd Court, Barrackpore, North 24 Parganas. It appears that process was directed to be issued under Section 452 of the Companies Act by an order dated February 17, 2023. Thereafter, on successive dates, the matter was adjourned awaiting service of process upon opposite party no. 2. It further appears that the learned Magistrate has repeatedly adjourned the matter for want of a service report. Mr. Satadru Lahiri, learned counsel appearing for the petitioner, submits that opposite party no. 2 was an employee of the petitioner who retired in the year 2017 and that all his retiral dues were duly paid in the year 2019. Having regard to the aforesaid facts and circumstances, this revisional application is disposed of with a direction upon the learned Magistrate in the Court below to ensure that service of process upon opposite party no. 2 is effected through the local police station within a period of one month from the date of communication of this order. 2 Upon service being effected upon opposite party no. 2, the learned Magistrate shall make every endeavour to dispose of the complaint case as expeditiously as possible, preferably within a period of one year from the date of service of process upon opposite party no. 2. Accordingly, CRR No. 2974 of 2026 stands disposed of. Liberty is granted to the petitioner to file an appropriate application before the learned Magistrate for preponement of the next date of hearing. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.)
