1. Heard.
2. After arguing for some time, learned counsel for the petitioner seeks permission of the Court to withdraw this petition with liberty to file appeal challenging the Order dated 09.01.2023 passed by the BINI PRADEEP Digitally signed by BINI PRADEEP DN: cn=BINI PRADEEP, ou=HIGH COURT, o=HIGH COURT OF CHHATTISGARH, st=Chhattisgarh, c=IN
2 Executive Council of the Respondent University as well as the subsequent Charge Sheet issued against the petitioner, before the Hon’ble Visitor under Section 8(10) of the Central University Act, 2009.
Learned counsel further submits that interim protection granted by this Court vide Order dated 10.5.2023 may be continued, till filing of the appeal before the Hon’ble Visitor.

Learned counsel appearing for respondents 2 & 3 has no objection on the aforesaid prayer of liberty.

Since an efficacious remedy is available to the petitioner for challenging the order dated 09.01.2023 passed in Agenda Item No. 9 and the subsequent issuance of the charge-sheet before the Hon'ble Visitor under Section 8(10) of the Central Universities Act, 2009, which remedy the petitioner intends to avail, he is permitted to withdraw the present petition with liberty to file an appeal within 30 days from today.
5. It is further observed that the interim protection granted by this Court vide order dated 10.05.2023 shall remain operative till the filing of the appeal. In the event the petitioner files an appeal along with an application seeking interim relief, the interim protection shall continue until disposal of such interim application by the Hon'ble Visitor.
