1. The present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 439 Cr.P.C.) seeking grant of regular bail to the petitioner in case FIR No.99 dated 02.07.2025, registered under Sections 22 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Makhu, District Ferozepur. During the course of hearing, the petitioner has also prayed for grant of interim bail to enable him to appear in the 3rd Semester LL.B. examinations. 2. search of co-accused Bhuvnesh Kumar, 400 grams of ice (Crystal Methamphetamine) drug was recovered from the pocket of his trouser. 3. Learned senior counsel for the petitioner submits that the petitioner is a law student and is eligible to appear in the 3rd Semester LL.B. examinations. It is contended that the examinations are scheduled to be held from 22.07.2026 to 14.08.2026 and, therefore, the petitioner be granted interim bail for a limited period so that he may appear in the said examinations and he does not wish to press the regular bail at this stage. It is further submitted that the petitioner shall abide by all the terms and conditions that may be imposed by this Court and shall surrender before the Jail authorities immediately upon expiry of the period of interim bail. 4. Pursuant to the order dated 23.07.2026, learned State counsel, upon instructions and after verification, submits that the petitioner has been found eligible to appear in the 3rd Semester LL.B. examinations scheduled from 22.07.2026 to 14.08.2026. Learned State counsel, however, opposes the prayer for grant of regular bail keeping in view the nature of the allegations against the petitioner. 5.
I have heard learned counsel for the parties and have considered their respective submissions. 6. The verification conducted by the respondent-State confirms that the petitioner is eligible to appear in the 3rd Semester LL.B. examinations commencing from 22.07.2026 to 14.08.2026, however, the petitioner has to appear for his first exam on 30.07.2026 and his last exam is scheduled to be held on 12.08.2026. to appear in the said examinations and such eligibility now stands verified, this Court is of the considered view that a limited concession of interim bail deserves to be granted. 7. Accordingly, the prayer for grant of regular bail is dismissed as not pressed at this stage. However, the petitioner is ordered to be released on interim bail from 29.07.2026 to 14.08.2026, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned Trial Court/Duty Magistrate concerned. The petitioner shall utilize the concession of interim bail only for the purpose of appearing in his examinations and shall not, directly or indirectly, influence any prosecution witness or tamper with the prosecution evidence. The petitioner shall surrender before the Superintendent/Jail Authorities concerned on 14.08.2026 at 5:00 P.M., on the expiry of the period of interim bail. 8.
