Gain. …for the de facto complainant. Learned advocate appearing for the petitioners submits that the petitioners are innocent and have been falsely implicated in connection with the instant case. Learned advocate for the de facto complainant submits that the eye of the de facto complainant has been severely injured pursuant to an injury inflicted by the accused persons. State has produced the injury report as well as the statement of the injured. 2 I have taken into account the overall materials and the statement of the injured specifically divulges the name of the petitioner no.1 in the overt act for commission of the alleged injury. Having regard to the same, I am of the view that the prayer for anticipatory bail of the petitioner no.1 cannot be granted. Accordingly, the prayer for anticipatory bail of the petitioner no.1, namely, Injamul Molla alias Injamamul Haque Molla is rejected. So far as the petitioner nos.2, 3 and 4 are concerned, I am of the view that their custodial detention/interrogation is uncalled for. As such, the prayer for anticipatory bail of the petitioner nos.2, 3 and 4 are allowed. Accordingly, in the event of arrest, the petitioner no.2, namely, Younus Ali Molla, the petitioner no.3, namely, Sahabul Islam Molla and the petitioner no.4, namely, Jahanara Molla shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, the petitioner nos.2 and 3 shall report to the investigating officer of the case within a period of 10 days from date and thereafter on all subsequent dates fixed by the investigating officer of the case for the sake of investigation. With the aforesaid observations, CRM(A)2485 of 2026 is partly allowed. Memo of Evidence submitted by the State be kept with 3 the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
