Mr. Kailash Chandra Tewari and Mr. Vibhor Tewari, learned counsel for the applicants. 2. Mr. Bhaskar Joshi, learned A.G.A. for the State. 3. This first bail application has been moved by the applicants seeking regular bail in F.I.R. No. 94 of 2025, under Sections 318(4), 338, 336(3), 340(2), 61(2), 115(2), 351(2), 352, 111(2)(b) of B.N.S., registered at Police Station Rani Pokhari, District Dehradun. 4. In the present case, FIR was lodged by the complainant, wherein, it is alleged that on 06.12.2022, the applicants entered into an agreement with the complainant for selling 130 sq. Gaj of land in Khatoni No. 00111, Khasra No. 968 situated in Mauja Ranipokhri Grant, Dehradun. The total sale consideration for the land was Rs. 5,40,000/-, out of which, the complainant paid Rs. 4,90,000/- by cash and cheque and the remaining amount was to be given when registered deed was to be executed. After several reminders, the applicants did not turn up for registration of the land and when the complainant went to the house of the applicants, the applicant and his wife threatened the complainant. It is further alleged in the FIR
that when the complainant inquired about the said land in the Tehsil, she discovered that the applicants already sold the said land to some other person by a different agreement. Learned counsel for the applicants has further contended that earlier in some other complaint concerning the same land, SIT was constituted and it has come in the SIT report that applicants have committed no illegal act. 5. Learned State Counsel, on the other hand, has vehemently opposed the bail application. 6. Be that as it may, the contents of the FIR would reveal that it is a dispute purely civil in nature which has been given the colour of criminal offence. 7. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicants deserve bail at this stage. 8. The bail application is allowed. 9.
Let the applicants, namely Kamal Swaroop and Tara Devi be released on bail, on their executing personal bond and furnishing two reliable sureties, each of like amount, by each one of them, to the satisfaction of the Court concerned. (Alok Mahra J.)
