Rakib (Rejected) CRM (NDPS) 1679 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hingalganj Police Station case no. 21 of 2025 dated 03.02.2025 under Sections 21(c)/29 of the NDPS Act. Learned advocate appearing for the petitioner submits that petitioner is in custody for one year six months. Petitioner has been falsely implicated in connection with the instant case for alleged recovery of 300 bottles of phensedyl. Other accused person has been granted bail, as such, petitioner be released on bail. Learned advocate appearing for the State opposes the prayer for bail and submits that there are additional accusations under the Foreigners Act. So far as the present petitioner is concerned, recovery was from the present petitioner and the person who has been granted bail against him there were statement only. Having considered that the petitioner is a foreigner who has been arrested at the BOP by the BSF, I am not inclined to release the petitioner on bail. 2 Accordingly, prayer for bail of the petitioner in CRM (NDPS) 1679 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
