Mr. Kallol Mondal, PP Mr. Subhendu Sinha Roy Mr. Dipayan Das …for the State. Learned advocate appearing for the petitioner submits that so far as the recovery in the present case is concerned, the same is 34.11 kg. but from the materials available in the case diary, it reveals that the weight of the bags were not distinguished which has been seized in the present case. Petitioner is in custody for one year and five months, although the evidence is in progress but prosecution would consume substantial time as they have relied upon 16 witnesses. Learned Public Prosecutor appearing for the State opposes the prayer for bail. Having considered the facts of the case, I direct that the petitioner be well advised to renew the prayer for bail 2 after the evidence of independent seizure list witnesses are over. To that effect, learned trial court would ensure that within a period of three months from the date of communication of this order, the independent seizure lists are concluded. With the above observations, CRM (NDPS) 1549 of 2026 is dismissed. Memo of evidence filed by the State is taken on record.
