1. The petitioner by way of present writ petition seeks writ in the nature of mandamus directing respondents to discharge their statutory obligations, to ensure continuing protection, regulation and preservation of the street No.9, Tafazalpura, Patiala and to decide the detailed representation dated 16.05.2026 (Annexure P-5).
2. As per the petitioner, there are illegal encroachments in the municipal street No.9, Tafazalpura, Patiala. As per petitioner, he has moved a representation before the Municipal Authorities to remove the same. However despite his representation, the Municipal Authorities have remained inert.
3. In the considered opinion of this Court, the issue with respect to encroachment etc. are disputed questions of fact which cannot be gone into without taking evidence on record which is beyond the DINESH KUMAR 2026.07.28 18:28 I attest to the accuracy and integrity of this document

4. The writ jurisdiction cannot be abused to conduct roving enquiry to ascertain as to whether there is any illegal encroachment or not. The petitioner has remedy(s) under the provisions of Punjab Village Common Lands Act, 1961.
5. In view thereof, this Court finds that the present petition cannot be entertained and the same is ordered to be dismissed. Liberty is however granted to the petitioner to avail his remedies, in accordance with law.
