CRM-M-40781-2026 -1- IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH 103 CRM-M-40781-2026 Date of decision: 27th July, 2026 Ramandeep Singh @ Ramandeep Singh Guron and another ...Petitioners Versus State of Punjab ...Respondent CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA Present: Mr. Manpreet Singh Bhatti, Advocate for the petitioners. Ms. Ruchika Sabherwal, Sr. DAG, Punjab. *** MANISHA BATRA, J (ORAL):- The instant one is the second petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioners seeking grant of anticipatory bail in case bearing FIR No. 352 dated 15.12.2025 registered under Sections 115(2), 118(1), 126(2), 3(5) and 351(2) of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’) (Section 117(2) of BNS was added later on) at Police Station Samrala, District Ludhiana. Their previous petition bearing CRM-M-33488-2026 had been dismissed as withdrawn vide order dated 11.06.2026. 2. As per the allegations, on 14.12.2025, elections for Zila Parishad and Block Samiti were taking place in village Bhardhala. Harbir Singh, brother of the complainant Gurjeet Singh, was nominated as a polling agent PARVEEN SHARMA 2026.07.28 10:25 I attest to the accuracy and integrity of this document CRM-M-40781-2026 -2- for Tejpal Singh. A scuffle had taken place between Harbir Singh and Navjot Singh, who was a member of the rival party. However, with the intervention of some persons, the matter was pacified. On the same evening, when the complainant was present outside the shop of a co-villager-Sohan Singh, suddenly, the petitioners, accompanied by Navjot Singh and other co-accused, reached there, armed with weapons. Accused Navjot Singh raised a lalkara to catch hold of the complainant and to teach him a lesson for having an altercation with him. Thereafter, all the assailants encircled the complainant. The petitioner No.1 struck blows with sharp-edged weapons on the right bicep of the complainant, whereas the other accused also inflicted blows with lathis, dandas, and sharp-edged weapons. The complainant fell on the ground but was still subjected to beatings. On an alarm being raised, the assailants fled from the spot. The complainant was rushed to the hospital. After registration of the FIR, investigation proceedings were initiated and are underway. Apprehending their arrest, the petitioners moved an application for grant of anticipatory bail, which was dismissed by the Court of the learned Additional Sessions Judge, Ludhiana, vide order dated 02.06.2026. 3. It is argued by learned counsel for the petitioners that they have been falsely implicated in the present case. Their alleged role is confined to a single act of assault. It is a case of political rivalry. Their antecedents are clean. They are ready to join the investigation. Their custodial interrogation is not required. No recovery is to be effected from them. In the case of co- accused Navjot Singh, interim relief has been granted. It is, therefore, argued PARVEEN SHARMA 2026.07.28 10:25 I attest to the accuracy and integrity of this document CRM-M-40781-2026 -3- that the petitioners also deserve to be granted the concession of anticipatory bail. 4. Notice of motion. 5. Larned State counsel has advance notice of the petition and has submitted that shortly after withdrawal of the previous petition filed by the petitioners, they have filed the present petition without there being any drastic or substantive change in the circumstances. They were specifically named in the FIR, and specific roles have been attributed to them. The victim sustained simple as well as grievous injuries at the hands of the petitioners and the co- accused. There is no exceptional or extraordinary circumstance warranting the grant of pre-arrest bail. Moreso, the instant petition, being a successive petition, is not maintainable. It is, therefore, argued that the petition does not deserve to be allowed. 6. This Court has heard the rival submissions made by learned counsel for the parties at considerable length. 7. The petitioners are alleged to have voluntarily caused simple as well as grievous injuries to the complainant. The previous petition filed by the petitioners had been dismissed as withdrawn only on 11.06.2026. The present petition has been filed by submitting that interim relief has been granted to one of the co-accused. However, this cannot be considered to be a material or substantive change in the circumstances so as to warrant consideration of the maintainability of the present petition, which is a successive one. More so, specific roles and injuries have been attributed to the petitioners. It is a well- PARVEEN SHARMA 2026.07.28 10:25 I attest to the accuracy and integrity of this document CRM-M-40781-2026 -4- settled proposition of law that the power to grant anticipatory bail is required to be exercised only in exceptional and extraordinary circumstances. Even otherwise, the petitioner has failed to make out any exceptional or extraordinary circumstance for grant of pre-arrest bail to him. It is well settled that anticipatory bail to an accused can be granted in exceptional circumstances only as a person couched in comparative safety of pre-arrest bail would certainly not disclose all the facts within his knowledge. In case custodial interrogation of the petitioner is denied to the Investigating Agency, that shall leave many glaring loopholes and gaps, thereby adversely affecting the investigation. In view of the above discussed facts and circumstances, this Court is not inclined to grant concession of pre-arrest bail to the petitioner. Accordingly, the petition is dismissed. 8. It is made clear that the observations made hereinabove are only for the purpose of deciding the present petition and the same shall not be construed as an expression of opinion on the merits of the case. 9. Since the main petition has already been disposed of, pending application, if any, is rendered infructuous. [MANISHA BATRA] JUDGE 27th July, 2026 Parveen Sharma 1.
