JUSTICE NIRZAR S. DESAI Date : 03/09/2026 ORDER Leave to correct the name of respondent No.1 by deleting the word ‘State of Gujarat’. 2. It is the case of the petitioner that despite clearing all the outstanding dues of the respondent Nos.2 and 3, the electric connection of the petitioner is not being restored. 3. In view of the above submission, learned advocate Mr. Anuj K. Trivedi appearing for respondent Nos.2 and 3, under instructions, states that there is no dispute that the petitioner has cleared all the outstanding dues, but at the relevant point of time, when the petitioner opted for restoration of the electric connection, electricity theft case was going on against the petitioner which is over now. In view of the Policy framed by the respondent Nos.2 and 3 as per GERC Code, the petitioner is now required to apply for fresh electric connection and when the petitioner applies for the C/SCA/12476/2026(GJHC240595032026) ORDER DATED: 03/09/2026 same, the same shall be considered in accordance with the GERC Code and new connection shall be provided to the petitioner, subject to the petitioner’s statement that he has already cleared all the outstanding dues of the electricity company. 4. In view of the above assurance given on behalf of respondent Nos.2 and 3, the petitioner shall have to apply for fresh electric connection in accordance with the GERC Code as stated by learned advocate Mr. Anuj K. Trivedi. Learned advocate Ms. Mariya Dalal appearing for the petitioner states that the petitioner shall be advised accordingly. 5. In view of the above, learned advocate Ms. Mariya Dalal, under instructions, seeks permission to withdraw this petition at this stage. Permission as prayed for is granted.
