Case No. 253 of 2021 dated May 20, 2021, under Sections 447/325/326/307/506/34 of the Indian Penal Code, 1860, pending before the Court of the learned Judicial Magistrate, 3rd Court, Paschim Medinipur. The petitioner is one of the accused persons in this case. It appears that total eight witnesses have been cited in the charge-sheet. Learned advocate appearing for the petitioner submits that examination of P.W.1 was complete. His cross-examination was, however, deferred due to his absence. In that view of the matter, I dispose of this revisional application with a direction upon the learned Magistrate in the Court below to conclude the trial as expeditiously as possible, preferably within a period of two years from the date of communication of this order. 2 It is made clear that if any of the witnesses fails to appear before him, learned Magistrate shall issue bailable warrant of arrest to secure their presence. Accordingly, CRR 3289 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
