5. By means of this writ petition, petitioner has sought the following reliefs:-
“I. Issue a writ, order or direction in the nature of Mandamus commanding the respondents to correctly re- fix the pay of Late Shri Ansuya Prasad Nautiyal, retired Assistant Development Officer (Panchayat), strictly in accordance with applicable Government Orders, including Government Orders dated 13.04.2000, 30.06.2003, and subsequent pay revisions, by granting the correct Promotional pay scale of ₹2200-4000, selection grade, and all consequential benefits from the due dates;
II. Issue a writ, order or direction directing the respondents to re-fixation and revise the pension and family pension of Late Shri Ansuya Prasad Nautiyal by taking into account the correctly re-fixed last drawn pay and to release all arrears of pension and family pension along with admissible dearness relief, from the date it became due;
III. Issue a writ, order or direction directing the respondents to ensure that the minimum family pension, as applicable under the 6th Pay Commission and subsequent Pay Commissions, plus dearness relief, with effect from the applicable date;
IV. Issue a writ, order or direction directing the respondents to comply with and implement the order dated 13.10.2015 passed by the Uttarakhand Human Rights Commission in Case No. 180/2015, in its true letter and spirit, within a time-bound period;
V. Issue a writ, order or direction directing the respondents, particularly the District Panchayat Raj
2026:UHC:2867 Officer, Nainital, to prepare and forward all necessary pension revision papers, including Forms 1 and 2, to the competent authorities for finalization of pension and family pension without further delay:
VI. Issue a writ, order or direction directing the respondents to pay interest at a reasonable rate of 1986 onwards on the delayed payment of pensionary and family pension benefits, in view of the inordinate delay of more than three decades;”

Learned counsel for the petitioner submits that petitioner has made several representations, but, no decision has been taken so far. He submits that petitioner be permitted to make fresh representation.

Learned State Counsel, however, submits that petitioner’s father late Anusuya Prasad Nautiyal retired in 1991 from the post of Assistant Development Officer (Panchayat) and thereafter he died in 1995. He submits that the benefit of Government Order, issued in 2000 cannot be given for pay fixation, retrospectively.
8. Accordingly, the writ petition is
disposed of with liberty to petitioner to make representation. If he makes representation to the Director, Panchyati Raj, Government of Uttar Pradesh, within two weeks from today, decision thereupon shall be taken, as per law, within six months thereafter.
