The revisional application has been preferred by the petitioner/husband praying for transfer of Matrimonial Suit no. 355 of 2025 from the Court of learned Additional District & Sessions Judge, 1st Court, Kakdwip, South 24 Parganas to the Court of learned District Judge, Alipore. 2. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the Matrimonial Suit has been filed in the Kakdwip Court, by the husband/opposite party herein. 3. The petitioner/husband herein resides at 4/8A, Haldia Township, P.S.-Haldia, Dist- Purba Medinipur, PIN- 721607. 4. Learned District Judge, Alipore shall proceed with the suit in accordance with law with due notice upon both the parties. 5. Learned counsel for the husband/petitioner submits that seven other proceedings initiated by the wife/opposite party are pending before the Court at 2 Haldia. As such the petitioner/husband prays for transfer of the matrimonial suit instituted by the wife/opposite party to Haldia. 6. Learned counsel for the wife/opposite party submits that the wife’s matrimonial home was at Haldia and as such some of the cases have been registered at Haldia but now that the wife/opposite party resides at Pathar Pratima, she has instituted the matrimonial case at Kakdwip Court. 7. Considering that it will be difficult for the wife to pursue the case at Haldia from Pathar Pratima and the husband from Haldia to Kakdwip. 8. Keeping in mind the convenience of both the parties, the matter be withdrawn from the Court of learned Additional District & Sessions Judge, 1st Court, Kakdwip, South 24 Parganas and be transferred to the Court of learned District Judge at Alipore. 9. Keeping in mind the case of both the parties herein, the learned Additional District Judge shall be at liberty to permit the parties to appear virtually, if such prayer is made. 10. CO 960 of 2026 is disposed of. 11. Parties to act on the server copy of this order. 12. Let a copy of this order be sent to the concerned Courts for immediate compliance. [Shampa Dutt (Paul). J]
