The matter was referred to the mediation and the same was settled under a memorandum of settlement under Section 89 of Code of Civil Procedure, 1908 r/w Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005 arrived at between the parties. 2. In terms of the settlement, matter is settled for an amount of Rs.3,40,000/- as full and final settlement. The revision petitioner had already deposited a sum of Rs.80,000/- and the said the amount was already withdrawn by the respondent and also he had paid an amount of Rs.1,00,000/- by way of cash to the respondent which was acknowledged by the respondent. - 3 - HC-KAR CNR: KAHC010237982026 NC: 2026:KHC:40426 CRL.RP No. 567 of 2026 Now the balance payable is Rs.1,60,000/-, for which given post dated cheques dated 30.09.2026 for an amount of Rs.80,000/- and also another cheque for an amount of Rs.80,000/- payable on 31.10.2026. 3. In view of the settlement arrived at between the parties and also the respondent has agreed to close the case in C.C. No.359/2023 filed against the revision petitioner in accordance with law. 4. In view of settlement arrived at between the parties, this revision petition is disposed of subject to payment of amount of Rs.1,60,000/- as agreed in terms of the post-dated cheques. 5. The petitioner is directed to deposit the fine amount of Rs.5,000/- within two weeks before the trial Court and produce the receipt in the registry thereafter within a week.
