07/08/2026 D/L – 51 Court No.35 S. Kundu Partly allowed C.R.M.(A) 839 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with English Bazar P.S case no. 1414 of 2025 dated 04/07/2025 under Sections 108 of the BNS. In the matter of: JaGannath Mandal & Ors. ...Petitioners. Mr. Kazi M. Rahman …for the petitioners. Mr. Somnath Adhikary …for the State. Learned advocate for the petitioners at the inception do not intend to press this application for petitioner no.1 (JaGannath Mandal) and petitioner no. 2 (Madhabi Mandal) who were arrested and subsequently granted bail. Consequently, their application for anticipatory bail is deemed to be infructuous. So far as the petitioner nos. 3 and 4 are concerned, learned advocate submits that they are innocent and have been falsely implicated in the present case. Learned advocate for the State has produced the case diary. Prima facie, I find that the accusation do substantiate the alleged offence under section 306 of the IPC. Having considered the same, I am of the opinion that the petitioner nos. 3 and 4 is unwarranted. 2 Thus, prayer for anticipatory bail is allowed. In the event of arrest, the petitioner nos. 3 and 4 shall be released subject to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. As the investigation of the case is in progress, the said petitioners will make themselves available as and when called for by the I.O. The petitioner no. 4 would meet with the I.O within a period of 10 days and all subsequent dates as fixed by the I.O. Accordingly, the application for anticipatory bail being CRM(A) 839 of 2026 is allowed-in-part. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
