1. Heard learned counsel for the petitioner.
2. It is during the course of the arguments, fairly conceded by learned Sr. Counsel for the petitioner that the chargesheet has reached to the final conclusion. He further argued that having regard to the fact that the petitioner is in custody for more than five years, the Trial court is required to conclude the chargesheet at the earliest.
3. When confronted with the fact that since the matter has reached to the final conclusion rather than insisting upon petitioner being released on bail, it shall be the endure of the counsel for the defense to make all efforts to ensure that the trial is concluded at the earliest.
4. Learned counsel for the petitioner, therefore, submits that in case time line are set for the Trial court for disposal of the chargesheet he would not press for grant of bail of the petitioner at this stage.
5. Given the aforesaid submission, this application is dismissed as not pressed with the direction to the Trial court that since the case arose of an incident of year 2021 and given the submission made, the petitioner is already in custody of over five years. The Trial court is expected to dispose of the chargesheet at the earliest. Even, otherwise also his case is covered under the Action plan which stood formulated by the High Court for speedy disposal of such cases.
6. Keeping that aspect in view, since the chargesheet is stated to have reached to the final conclusion, the Trial court is directed to conclude the proceedings within three months from today and in case the time line is not met with, the petitioner is given to liberty to file a fresh bail application that shall be disposed of by the Trial court in accordance with law.
7. Dismissed as above.
