2 Squad, Surguja, District – Surguja (C.G.), for the offence punishable under Section 22(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution is that on 01.03.2026, the police received secret information that Abhishek Kumar Sahu was carrying and selling narcotic drugs in car No. CG-29-AG-1098 near Tilsinwa Ground School. The vehicle was intercepted in the presence of witnesses, and upon search, 560 Alprazolam 0.5 mg tablets and 48 Spasmo-Proxyvon Plus capsules were allegedly recovered and seized. The accused was arrested after completion of the requisite proceedings, and the seized substances were sealed. Accordingly, Crime No. 182/2026 was registered under Sections 22(c) and 29 of the NDPS Act. After investigation, a charge-sheet was filed against the accused for the said offences. 3. Learned counsel for the applicants submits that the applicants have been falsely implicated in this case. It is argued that the alleged recovery has not been made from the conscious and exclusive possession of the applicant and that the prosecution story is based primarily on the information received from an informant. It is further submitted that the investigation has already been completed and charge-sheet has been filed. He further submits that the applicant is in jail since 01.03.2026 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4.
On the other hand, the learned State counsel opposes the bail application of the applicant and submits that and submits that the allegations against the applicant are serious in nature. The applicant
3 has failed to give any satisfactory explanation, which shows that it is an organized crime. Therefore, the bail application filed by the applicant is liable to be dismissed. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and the fact that recovery of 560 Alprazolam tablets and 48 Spasmo-Proxyvon Plus capsules is the commercial quantity and the applicant has failed to give any explanation for the same and it cannot be a case of false implication. 7. Accordingly, the bail application of the applicant – Abhishek Kumar Sahu, involved in Crime No.182/2026 registered at Police Station – Excise Department, Divisional Flying Squad, Surguja, District – Surguja (C.G.), for the offence punishable under Section 22(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. , is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
