The petitioner is apprehending his arrest in connection with Tandwa P.S. Case No.62 of 2024, registered for the offence under Sections 379, 411, 34 of the Indian Penal Code, pending in the Court of the learned Additional Chief Judicial Magistrate, Chatra. 3. Learned counsel appearing for the petitioner submits that only on the basis of CDR, the petitioner has been implicated in the case. He further submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 13 of this application. He next submits that iron angle has been stolen by apprehended co-accused, namely, Akash Sheikh. 4. Learned counsel appearing for the State opposed the prayer and submits that in the CDR, the petitioner was found to be talking with the said Akash Sheikh. 5. Considering that the petitioner has been implicated in the case only on the basis of CDR and he is having no criminal antecedent in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper. 6.
