Mr. Saptarshi Kundu ….for the petitioner The learned advocate appearing for the petitioner submits that though the application under Section 151 of the Code of Civil Procedure was allowed directing the police authorities to implement the order but the order has been not implemented in its true letter and spirit. It appears from the order impugned that police assistance has been granted and compliance report was also submitted before the Court. The learned trial judge has recorded that no cogent or convincing material has been placed on record to establish deliberate violation of the order to warrant further direction. CO 1811 of 2026 stands disposed of by giving liberty to the petitioner to approach the learned trial judge with relevant materials in case the petitioner feels that the order of injunction has not been implemented. If the learned trial judge is approached, necessary orders in accordance with law shall be passed. There will be no order as to costs.
