ORAL ORDER The petitioners call in question the registration of a crime in crime No.37/2024 registered for an offences punishable under Sections 498A, 323, 504, 506 and 34 of the Indian Penal Code, 1860 ('the IPC' for short) and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. P. Nehru, learned counsel appearing for the petitioners, Smt. M.M. Waheeda, learned High Court Government Pleader appearing for respondent No.1 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a

settlement and the memorandum of settlement reads as follows:
“MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. The parties above named beg to submit as follows:-
The petitioner has filed this petition under Section 13(1)(i-a) of the Hindu Marriage Act 1955. I. The aforesaid petition was referred to mediation for resolving the dispute between the parties. In the course of mediation, they have resolved their dispute and have agreed to the following, terms and conditions:
1. The petitioners are Hindus by religion. Their marriage took place on 9-9-2022 at Sri. Shiva Parvathi Kalyana Mantapa, No. 315. 3rd Main, 4th Cross, Banaswadi, Bangalore 560 043 as per the formalities, rites and customs prevailing in their community. 2. Both the parties state that they have no children born to them from their wedlock. 3. Due to irreconcilable differences and incompatibility of temperaments, the petitioners have been living separately since 13-4-2023. The efforts made by the elders, friends and well-wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of reunion amongst them. Hence, the parties have decided to get the marriage between themselves dissolved by a decree of divorce. 4. Both the parties are gainfully employed as such they have no claims of

maintenance/permanent alimony against each other. 5. The respondent has filed MC No. 5782 of 2023 praying for restitution of conjugal rights. That the respondent undertakes and agrees to withdraw the said petition. The petitioner agrees to the same. 6. That the petitioner has filed Crl.
Misc No. 232 of 2023 under the provisions of the Protection of Women from Domestic Violence Act., against the respondent, this father and mother. The petitioner undertakes and agrees to withdraw the said case within 15 days from receiving the certified copy of this case. The respondent agrees to the above. 7. That the petitioner has filed FIR No. 037 of 2024 for offences punishable under Sec.
498A, 323, 504, 506, 34, IPC R/w Sec 3,4 of Dowry Prohibition Act., against the respondent, father, mother, brother and sister pending before the Honorable 6th Addl CMM Court, Nrupatunga Road, Bangalore. The respondent shall file quashing application before the Honorable High Court of Karnataka. The petitioner undertakes and agrees to participate in assist in the quashing of the said case/proceeding. The respondent agrees to the above. 8. The parties state that they have no claims of whatsoever manner against each other and also of movables or either immovable properties belonging to each other. 9. The parties have already exchanged the articles belonging to each other and as such all their claims are fully satisfied. - 6 -

10. The parties further state that there has been no collusion or force, fraud or any undue influence in filing the above petition and entering into this compromise in the aforesaid manner. 11. Both the parties admit that they shall not interfere in the lives of each other in future. II. In view of the aforesaid agreement entered into between the parties, the parties pray that this Honorable Court be pleased to dissolve the marriage dated 09-09-2022 that took place at Sri. Shiva Parvathi Kalyana Mantapa, No. 315, 3rd Main, 4th Cross, Banaswadi, Bangalore 560 043, by granting a decree of divorce. III. Parties will appear on 17-04-2026 before the court for passing orders in terms of this agreement. 4.
In light of the settlement arrived at between the parties as afore-quoted, I pass the following:
ORDER (i) Criminal Petition is disposed. (ii) The investigation in crime No.37/2024 pending before the 6th Additional Chief Judicial Magistrate, Bengaluru stands quashed.
