JUSTICE PRAVEER BHATNAGAR Order [2026:RJ-JP:18401] (2 of 4) [CRLMB-3116/2026] 30/04/2026 1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No. 633/2023 registered at Police Station Kotwali, District Dausa for the offences under Sections 147, 148, 149, 458, 323 and 302 of IPC. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is contended that the other co-accused, namely Himanshu @ Bantu, Sitaram, Ramsawroop, Shankar, Kamlesh, Amit, Prithviraj and Trivenishyam, were enlarged on bail by the co-ordinate Benches of this Court vide various orders. It is further contended that co- accused Akash @ Bhupesh was granted bail by the Hon’ble Apex Court in SLP (Crl.) No. 8899–8901/2025. It is alleged in the FIR that the present petitioners along with 20–25 other persons, entered into the house of the deceased and caused fatal injuries, which resulted in her death. It is also alleged that the family members of the deceased, namely Moolchand, Guddi and Babulal, sustained injuries in the incident. It is further contended that the charge-sheet was initially filed against co-accused Himanshu, Sitaram, Ramswaroop, Pradeep Singh and Shankar while the investigation against other co-accused was kept pending under Section 173(8) Cr.P.C. Thereafter, a supplementary charge-sheet was filed against Akash, Kamlesh and Amit, followed by a third charge-sheet against co-accused Prithviraj Chauhan and Trivenishyam. Subsequently, a fourth charge-sheet was submitted against Rajesh Yadav. A supplementary charge-sheet against the [2026:RJ-JP:18401] (3 of 4) [CRLMB-3116/2026] present petitioners was filed on 27.01.2026. The accused- petitioner Praveen was arrested on 15.01.2026, Akash on 17.11.2025 and Ashok on 03.11.2025. It is also contended that Babulal, stated in his deposition that all the co-accused, along with the present petitioners, assaulted them, as a result of which Ladoo Devi sustained severe injuries and died. Thus, the allegations against the present petitioners are not specific, but rather omnibus in nature. The trial of the case may take considerable time, therefore, the bail applications of the accused- petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail applications and contended that witnesses in their statement rendered under Section 161 Cr.P.C. have clearly stated that petitioners Akash alongwith co-accused Himanshu caused injuries to the deceased, therefore considering the statement of injured witnesses, their bail applications deserves to be dismissed. 4. Heard and perused the material available on record. 5. Similarly placed co-accused Himanshu @ Bantu, Sitaram, Ramsawroop, Shankar, Kamlesh, Amit, Prithviraj and Trivenishyam were enlarged on bail by the co-ordinate Benches of this court vide various orders and the co-accused Akash @ Bhupesh was granted bail by Hon'ble Apex Court. The accused-petitioners are in custody since long and the trial of the case may take considerable time, therefore without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners [2026:RJ-JP:18401] (4 of 4) [CRLMB-3116/2026] 1. Praveen Kumar S/o Lalit Kumar, 2. Ashok S/o Hansraj 3. Akash @ Illu S/o Mahesh Chand, in connection with FIR No. 633/2023 registered at Police Station Kotwali, District Dausa shall be enlarged on bail provided each of them furnish personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
