In the writ petition criminal prosecution being Md. Bazar Police Station Case No. 267 of 2026 dated 30th July, 2026 is questioned. 2. Mr. Bhattacharya, learned senior advocate representing petitioner submits that based on search and seizure made on 29th July, 2026 criminal prosecution was initiated which is wrong approach so far police authorities are concerned. 3. Petitioner prays for direction thereby interdicting the aforesaid criminal prosecution. 4. This Court has delivered judgment on 20th August, 2026 in a writ petition being WPA 20108 of 2026 (Md. Nazibuddin Mondal @ Tulu 2 Mondal vs. The State of West Bengal & Ors.) where identical criminal prosecution was questioned. Therefore, no further elaboration is needed so far present writ petition is concerned filed by another person. 5. Judgment delivered on 20th August, 2026 shall govern the present writ petition and accordingly the present writ petition is dismissed. 6. Copy of judgment dated 20th August, 2026 duly countersigned by Assistant Registrar (Court) shall be retained with record. 7. In view of order passed today application being CAN 1 of 2026 is also dismissed. 8. Parties to act on server copy of this order duly downloaded from the official website of this Court.
