Accused No.6 in S.C.No.254/2019 pending before the Court of II Addl. District and Sessions Judge, Shivamogga, arising out of Crime No.389/2017 registered by Doddapete Police Station, Shivamogga, for offences punishable under Sections 143, 144, 147, 114, 323, 324, 307, 149 of IPC and Sections 25 and 27 of the Indian Arms Act, 1959, is before this Court in this criminal petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP appearing for the respondent-State. 3. FIR is Crime No.389/2017 is registered by the Doddapete Police Station, Shivamogga, against Jameer and others for the aforesaid offences based on the first information dated 04.09.2017 received from Abdul Saleem, who is the injured victim in the present case. Petitioner's name is not found in the FIR. After completing investigation, charge sheet is filed against 7 persons and - 3 - HC-KAR CNR: KAHC010336282026 NC: 2026:KHC:43853 CRL.P No. 7062 of 2026 petitioner is arraigned as accused No.6 in the charge sheet. Subsequently, he was arrested and produced before the Trial Court and was granted regular bail on 03.05.2021. It appears that thereafter, petitioner had not appeared before the Trial Court in S.C.No.254/2019 and his presence was secured on 23.06.2025 and on the said day, he was remanded to judicial custody. Subsequently, he was granted regular bail on 02.08.2025. Thereafter, once again petitioner had remained absent before the Trial Court and therefore, his presence was secured on 15.03.2026 and on the same day, he was remanded to judicial custody. His bail application filed thereafter before the Trial Court in S.C.No.254/2019, was rejected on 01.04.2026. Therefore, he is before this Court. 4. Perusal of material on record would go to show that the petitioner is a person with criminal antecedents and there are multiple cases registered against him. However, the last case registered against him was in the year 2023. In the present case, on the merits of the case, the - 4 - HC-KAR CNR: KAHC010336282026 NC: 2026:KHC:43853 CRL.P No. 7062 of 2026 petitioner, who was arrested, was granted regular bail by the Trial Court on 03.05.2021. 5. Learned counsel appearing for the petitioner has brought to the notice of this Court that petitioner’s wife was pregnant at the time of his arrest in the present case in the month of March 2026 and she has now given birth to a child. It is only for the said reason, he had not appeared before the Trial Court and he is now in custody for the last 5 months. 6. Considering the said submission and also the fact that the petitioner, who was earlier released on bail in the present case on merits, is now in custody for the reason that he has not appeared before the Trial Court on regular dates of hearing, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order: - 5 - HC-KAR CNR: KAHC010336282026 NC: 2026:KHC:43853 CRL.P No. 7062 of 2026 ORDER (i) The criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.254/2019 pending before the Court of II Addl. District and Sessions Judge, Shivamogga, arising out of Crime No.389/2017 registered by Doddapete Police Station, Shivamogga, for offences punishable under Sections 143, 144, 147, 114, 323, 324, 307, 149 of IPC and Sections 25 and 27 of the Indian Arms Act, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR CNR: KAHC010336282026 NC: 2026:KHC:43853 CRL.P No. 7062 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. f) Petitioner shall appear before the Station House Officer of the Doddapete Police Station, Shivamogga, on every first Sunday of the month between 10.00 a.m. to 11.00 p.m. and mark his attendance for a period of one year from the date of his release from the custody.
