1. The petitioner has filed the instant petition for following reliefs:-
“10.1 That, this Hon’ble Court kindly may kindly be pleased to issue an appropriate writ, order or direction directing Respondent Authorities to consider and decide the representation Petitioner's dated 23.06.2026 (ANNEXURE P-5) by passing reasoned and speaking order, strictly in accordance with law, within a stipulated period of 30 days or such other period as this Hon'ble Court may deem fit and proper and till the case of the Petitioners representation is not decided the notification with respect to the Petitioner's land be kept in abeyance qua the Petitioners Land in the interest of justice. 10.2 That, the Hon’ble Court may kindly be pleased to issue an appropriate writ, order or direction to the respondent authorities to exclude the land belonging to the Petitioner from the notifiication dated 19th May, 2026 in the interest of justice. 10.3 Any other relief or reliefs which this Hon'ble Court may deem and proper in present circumstances of the case.”

Learned counsel for the petitioner submits that the petitioner is the owner and in possession of the land in question, situated at Village Ramchandi, bearing Khasra Nos. 320/1, 320/2, 320/3, 320/4, 379/2, 320/916, 321/2, 379/2, 380/2, 380/3 and 382/3, admeasuring a total area of 4.102 hectares, which was purchased by the petitioner through a registered sale deed. It is further submitted that No Objection Certificates dated 29.10.2025 and 22.04.2026 were issued by the Airport Authority of India and the Chhattisgarh State Power Distribution Company Ltd., respectively. However, subsequently, the petitioner came to know that the
3 aforesaid land was proposed to be acquired by the State Government and, in this regard, a notification dated 07.05.2026 was issued by the NRDA. Thereafter, the requisite procedure was followed for placing the matter before the State Government for publication in the Official Gazette, and the Gazette Notification dated 19.05.2026 was accordingly published. He also submits that the objection raised by the petitioner against the proposed acquisition has not yet been considered. Consequently, the petitioner has submitted a representation dated 23.06.2026 (Annexure P/5) before the concerned authorities.
The petitioner, therefore, confines his prayer to a limited relief seeking a direction to the competent authority to consider and decide the aforesaid representation, in accordance with law, by passing an appropriate and reasoned order. 3. Learned counsel appearing for respondent No. 3 submits that, in view of the representation having already been submitted by the petitioner, the same shall be duly considered by the competent authority and an appropriate order shall be passed thereon in accordance with law. 4. Learned counsel for the State submits that, since the Gazette Notification dated 19.05.2026 has already been issued, the petitioner was aware of the intention of the respondent authorities to acquire the land in question and, therefore, at this stage, the petitioner's request for consideration of his objection may not warrant reconsideration. However, it is submitted that the
4 petitioner has specifically raised a grievance that he has not been afforded an opportunity of hearing. In view thereof, learned State counsel submits that he has no objection if the representation submitted by the petitioner is considered and decided by the competent authority in accordance with law. 5. Having heard learned counsel for the parties and considering the
facts and circumstances of the case, respondent No. 3 is directed to consider the representation submitted by the petitioner and pass a reasoned and appropriate order in accordance with law, preferably within a period of 60 days from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim, and the competent authority shall take an independent decision in accordance with law.
