For Petitioner(s): Mr. Mayil Vahana Rajendran.C For Respondent(s): Mr.Leonard Arul Joseph Selvam Additional Public Prosecutor for R1 To R2 ORDER This Writ Petition has been filed by the petitioner seeking direction to the Respondent Nos.1 and 2 to give adequate police protection while conducting the survey and demarcation of boundary works by fencing the petitioner’s land comprised in Survey No.403/2D situated at No.74B, Ponthandalam Village, Thirukkalukundram Taluk, Kancheepuram District, based on her representation dated 02.02.2026. 2. The petitioner has sent a representation dated 02.02.2026 to the first and second respondent complaining that by using forged documents, the third respondent is claiming right over her property in Survey No.403/2D situated at No.74B, Ponthandalam Village, Thirukkalukundram Taluk, Kancheepuram District and tried to put up some construction in her property. The contention of the petitioner is that earlier the petitioner had lodged a complaint to the respondent police in this regard. Since no action has been taken, the petitioner had filed a writ petition in W.P.(Crl.) No.1374/2025 and this Court vide order dated 19.11.2025 directed the respondent therein to register a case and the second respondent had also registered a case in Cr.No.272/2025 against the third respondent, however, no action has been taken against him. The third respondent further created obstructions and did not allow the petitioner to peacefully enjoy her property. Hence, the petitioner has sent the present representation dated 02.02.2026. 4. Learned Additional Public Prosecutor takes notice for R1 and R2 and submits that with regard to Cr.No.272/2025, he has no instruction. But as regards the petitioner’s representation dated 02.02.2026, now summons has been issued to the petitioner as well as the third respondent to appear for enquiry on 24.04.2026 and on the date of enquiry, investigation will be conducted and appropriate police protection will be given to the petitioner by ensuring that there is no encroachment by the third respondent or any intruders without any authority of law or orders from the competent court. 5. The learned counsel for the petitioner, on instruction, submits that the petitioner would appear for enquiry before the respondent police on 24.04.2026 without fail. https://www.mhc.tn.gov.in/judis WP Crl. Considering the above submissions, this Court directs the respondent police to conduct enquiry on 24.04.2026 and give adequate police protection to the petitioner while conducting the survey and demarcation of boundary works in the petitioner’s land in Survey No.403/2D situated at No.74B, Ponthandalam Village, Thirukkalukundram Taluk, Kancheepuram District and if any unreasonable encroachment or intrusion over the petitioner’s property is found, appropriate action shall be taken to remove the same, unless there is any order from the competent court and the concerned encroachers shall be warned accordingly. 7.
