Learned State counsel submits that land of the petitioner has never been encroached by the State Government for construction of village DEEPTI JHA Digitally signed by DEEPTI JHA 2 road, as such the relief claimed by the petitioner cannot be granted to him. 3. From perusal of record, it appears that reply was filed way back on 02.08.2023, however, neither any rejoinder has been filed by the petitioner, nor he is appearing for arguments of this case, as such it appears that the petitioner is not willing to prosecute his case further. 4. In view of above circumstance, in absence of any representation from the petitioner, this Court is left with no any other option, but to dismiss this petition for want of prosecution. 5. Learned counsel for the petitioners submits that matter has already been settled between parties, therefore, he seeks permission of this Court to withdraw this writ petition. 6.
