ORAL ORDER
1. Accused no.1 in S.C.No.203 of 2025, pending before the Court of I Additional Session Judge, Shivamogga arising out of Crime No.206 of 2025 registered by Shivamogga Rural police station, Shivamogga District, for offences punishable under Sections 115(2), 118(1), 109, 351(2), & 352 r/w Section 3(5) of BNS, 2023 and Sections 113 & 114 of Karnataka Police Act, 1963 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.206 of 2025 was registered against petitioner and two others, initially for the offence punishable under Sections 115(2), 118(1), 109, 351(2), 352 R/w Section 3(5) of BNS, 2023, based on the first information dated 15.07.2025 received from Sri Suresha K, who is the injured victim in the present case. During the course of investigation of the said case, petitioner was arrested on 09.10.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against three persons for the

aforesaid offences and petitioner is arrayed as accused no.1 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.1253 of 2025 was rejected on 20.12.2025. Therefore, he is before this Court. 4. Material on record would go to show that, on the alleged date of incident, accused nos.1 to 3 were found consuming alcohol in an under construction building belonging to the first informant. This was objected by the first informant and therefore, accused persons had assaulted the first informant and had caused injuries. In the said case, petitioner was arrested on 09.10.2025. It appears that, as on the date of alleged incident, there was an order of externment against the petitioner and in violation of said order, he had entered Shivamogga District and it is under these circumstances, subsequently in the charge sheet, offences punishable under the provisions the Karnataka Police Act, 1963 have been invoked against the petitioner. 5.
Learned Additional State Public Prosecutor has brought to the notice of this Court that injured victim has

suffered only two simple injuries in the incident in question. Wound certificate of injured victim would go to show that, corresponding injuries as a result of alleged assault made by the petitioner are not found. Petitioner is a person with criminal antecedents, as against whom an order of externment was passed, as on the date of alleged crime. Under the circumstances, I am of the opinion that, his prayer for grant of regular bail needs to be answered affirmatively subject to appropriate conditions.
ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.203 of 2025, pending before the Court of I Additional Session Judge, Shivamogga arising out of Crime No.206 of 2025 registered by Shivamogga Rural police station, Shivamogga District, for offences punishable under Sections 115(2), 118(1), 109, 351(2), & 352 r/w Section 3(5) of BNS, 2023 and Sections 113 & 114 of Karnataka Police Act, 1963, subject to the following conditions:

a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off. f) petitioner shall appear before the station House Officer of Shivamogga Rural Police Station on

every first and third Sunday of the month between 10.00 a.m. and 1.00 p.m. and mark his attendance regularly, till the case registered against him is
disposed off.
