ORAL ORDER
1. Accused no.1 in Crime No.108/2024 registered by Chickballapura Town Police Station, Chickballapura, for the offences punishable under Sections 181, 187, 197, 200, 205, 209, 210, 419, 420 of IPC, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.108/2024 was registered by Chickballapura Town Police Station for the aforesaid offences against the petitioner and others. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.335/2026 before the jurisdictional Sessions Court, which was rejected on
06.07.2026. Therefore, he is before this Court. 4. The material on record would go to show that petitioner had filed a petition in P & SC.No.68/2023 before the jurisdictional Court of District & Sessions Judge, Chickballapura,

and in the said petition, one Smt. Tarabai was arrayed as respondent no.3.
It appears that Smt. Tarabai had expired on 06.04.2016 and accused no.2 - Smt. Kasthuri Bai had received the notice issued by the Court on behalf of Tharabai on
10.04.2024. Subsequently, it came to the notice of the court that Tarabai had died on 06.04.2016 and it is under these circumstances, FIR was registered against the accused persons in the present case. 5. Petitioner, aged about 54 years, has no other criminal antecedents. The question whether deceased was made as party to P & SC proceedings deliberately requies adjudication. Investigation of the case is now completed and charge sheet is already filed. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order:
6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.108/2024 registered by Chickballapura Town Police Station,

Chickballapura, for the offences punishable under Sections 181, 187, 197, 200, 205, 209, 210, 419, 420 of IPC, subject to the following conditions:
1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
