Police Station case no. 294 of 2022 dated 12.12.2022 under Sections 395/397/170/467/468/471/120B/34 of the Indian Penal Code read with Sections 25(1B)(a)/27 of the Arms Act. Learned advocate appearing for the petitioner submits that another accused namely, Debabrata Karmakar has been granted by the Hon’ble Supreme Court on 20.04.2026 in Special Leave to Appeal (Crl.) No. 16546/2025. The spirit of the said order relates to delay in trial, as such the accused was granted bail. Petitioner is similarly placed so far as the powers under Article 21 of the Constitution of India is to be invoked. Accordingly, prayer for bail of the petitioner is allowed. As such, the petitioner, namely, Rajab Ali Gayen shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the 2 satisfaction of the learned Chief Judicial Magistrate, Alipore, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of South 24 Parganas without prior permission of the learned Trial Court. Thus, CRM (M) No. 1048 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
