This application under Article 227 of the Constitution of India is at the instance of the plaintiff/appellant in Title Appeal No. 45 of 2021 praying for a direction upon the learned Additional District Judge, Fast Track 1st Court, Howrah to dispose of the said title appeal expeditiously. From the order-sheets appended to this civil revision this Court finds that an application dated September 3, 2024 is fixed for hearing on December 9, 2026. Learned advocate appearing for the petitioners submits that the said application has been filed by the opposite-parties herein praying for permission to effect necessary repairs in the suit property. She further submits that the written objection to such application shall be filed within a week from date. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any
2 notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with a server copy of this order, upon the opposite parties or upon the learned advocate representing them before the learned trial judge. In the light of the submission made by the learned advocate appearing for the petitioners this civil revision application stands disposed of by requesting the learned Additional District Judge, Fast Track 1st Court, Howrah to take up the hearing of the application dated September 3, 2024 on the next date fixed, i.e., on December 9, 2026 and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the said application as well as any other application that may be pending, the learned Additional District Judge, Fast Track 1st Court, Howrah is requested to dispose of the Title Appeal NO. 45 of 2021 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
