……for the State. Learned advocate appearing for the petitioner submits petitioner is in custody for 4 months. The subject matter of the instant case referred to alleged recovery of 1646 bottles of Codeine Phosphate solution. Charge sheet has already been submitted before the jurisdictional Court and there has been diverse reliefs granted to other accused persons. Learned advocate for the State opposes the prayer for bail. This Court confronted the learned advocate for the State in respect of the call data records and money trail. Learned advocate for the State specifically stated that, from the case diary and the memorandum of evidence although there
2 are antecedents of the present petitioner but so far as the present case is concerned, call data records or money trail are not available. Having considered the factual circumstances of the present case, so far as the petitioner is concerned, where the substance available is statement of co-accused, I am of the opinion further detention of the present petitioner is unwarranted. As such, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Layek Ali @ Laltu shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1620 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
