1. Learned Counsel appearing on behalf of the petitioner submits that the petitioner is innocent and she left her matrimonial home in the year 2025. It is contended that the petitioner has no nexus with the alleged offence of abetment of suicide allegedly committed by her husband, and prayer is made for bail on such terms and conditions as this Court may deem fit, having regard to her two-year-old child.
2. Learned Advocate representing the State strongly opposes the anticipatory bail prayer and has placed reliance upon the Post Mortem Report, which indicates the victim suffered several injuries in his person.
3. Having heard the submission of the respective parties and on perusal of the materials-on-record including the Post Mortem Report, this Court finds the victim suffered several
2 injuries on his person, apart from the injuries suffered in the head in connection with earlier PTN No. WBML02P0181842026 arising out of Baishnabnagar Police Station Case No. 244/2026 dated 11.03.2026 under Sections 126(2)/115(2)/118(2)/110/3(5) of Bharatiya Nyaya Sanhita, 2023 pending before the Learned C.J.M., Malda. In view of such injuries and other statements of witnesses, this Court does not find sufficient reason to allow her prayer for bail. Accordingly, her prayer for anticipatory bail is rejected.
4. The application for anticipatory bail being CRM(A) 1971 of 2026 is, thus, rejected.
5. All concerned parties shall act on the server copies of this order duly downloaded from the official website of this Court.
6. Criminal Department is directed to supply urgent certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
