1. Heard Ms. Saumya Sharma, learned counsel for the petitioners. Also heard Mr. Jitendra Shrivastava, learned Govt. Advocate Digitally signed by MOHAMMED AADIL KHAN Date: 2026.08.19 14:39:53 +0530

2. The present petition has been filed by the petitioners with the following prayer:-
“1. That, the Hon’ble Court may kindly be pleased to allow the Instant petition under section 528 of Bhartiya Nagrik Suraksha Sanhita 2023 filed by the petitioner.
2. That, the Hon’ble Court may kindly be pleased to quash the FIR bearing Number 0201/2025 registered at Police Station Dhamdha District Durg (C.G.) on 31/12/2025 at 15:23 hours under section 106(1) and 3(5) of the Bhartiya Nyaya Sanhita 2023 and subsequently quash charge sheet charge sheet no. 11/2026 filed before the JMFC 1st Class Link Court, Dhamdha Durg (C.G.) on 5.02.2026 against the petitioner under section 106(1), 3(5) of BNS and section 13(d) of Chhattisgarh Rajya Upchar tatha Rog Upchar Adhiniyam 2010 and further be pleased to quash the cognizance order dated 02.03.2026 passed by the JMFC, 1st Class, Link Court, Dhamdha Dist: Durg (C.G.) in case number RCC/12/2026.
3. That, the Hon’ble Court may kindly grant for other relief as this Hon’ble Court may deem fit and proper in
facts and circumstances of the case.”
3. At the time of hearing, this Court observed that the petitioners
3 have not annexed the enquiry report in the petition, which is stated to be part of the charge sheet.
4. In such a situation, learned counsel for the petitioners seeks permission to withdraw the present petition with liberty to file a duly constituted petition.
5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.5,000/- as cost by the petitioners in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Govt. Observation Home, Durg (C.G.).
