ORAL ORDER
1. Accused No.2 in Crime No.122/2026 registered by the Mangalore South Police Station, Mangaluru District, for the offences punishable under Sections 8(c) and 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act for short), is before this Court in this petition filed under Section 483 of the BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.122/2026 was registered by Mangalore South Police Station, Mangalore District, for the aforesaid offences against one Janan and the petitioner based on the first information dated 08.06.2026 received from Keshava Murthy, Head Constable, attached to Mangalore South Police Station

and in the said case, the petitioner was arrested on 08.06.2026 and remanded to judicial custody. His bail application before the jurisdictional Sessions Court in Crime No.122/2026 was rejected on 01.07.2026. Therefore, he is before this Court. 4. A perusal of the material on record would go to show that FIR in Crime No.122/2026 in the present case was registered against accused Nos.1 and 2 at about 13 hours on 08.06.2026. In the first information, it is alleged that the first informant had credible information about accused Nos.1 and 2 being in possession of contraband articles and therefore, FIR was registered against them. In the raid that was conducted subsequently to the alleged spot, where accused Nos.1 and accused No.2 were in possession of contraband articles, the police had apprehended accused Nos.1 and 2 and from the possession of accused No.1, the contraband article allegedly MDMA totally weighing 11.68 gms., was recovered and seized under a panchanama. 5. It is not in dispute that from the possession of the petitioner, no contraband article has been seized in the present case. Accused Nos.1 and 2 were produced before the Court of

Special Judges in Crime No.122/2026 on 09.06.2026. The order sheet in Crime No.122/2026 would reflect that accused Nos.1 and 2 had complained before the Court that they were arrested on 07.06.2026 at about 7.30 pm., but produced on
09.06.2026. 6. The learned counsel for the petitioner has produced copies of the e-mails, which were forwarded by the family members of accused No.1 to the Commissioner of Police.
The same would go to show that even prior to registration of the FIR in the present case, e-mails were forwarded to the Commissioner of Police stating that Police officers, who had come to the house of accused No.1 on the night of 07.06.2026 had taken him along with them without even informing the reason for the arrest. Be that as it may, the fact remains that so far as the petitioner is concerned, there is no seizure of any contraband article from his possession. It is not in dispute that the petitioner has no other criminal antecedents. 7. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of

regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:
ORDER
The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.122/2026 registered by the Mangalore South Police Station, Mangaluru District, for the offences punishable under Sections 8(c) and 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed of.
