This writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking a direction to respondent no.2-District Magistrate, Udham Singh Nagar, to decide the application of the petitioner for registration of the armed license in Udham Singh Nagar after its transfer from State of Assam, where the petitioner got this armed license, within a stipulated time. 2. The facts of the case, shorn of unnecessary details, are that the petitioner was working in a Tea Garden in Tinsukia, State of Assam, and was issued an arms licence bearing No.928/NDAL/TSK for a pistol in his favour. The petitioner sought transfer the said licence to the State of Uttarakhand by registering it in District Udham Singh Nagar. For this purpose, the petitioner submitted an application dated 06.08.2024, annexure no.2 to the writ petition, to the District Magistrate, Udham Singh Nagar, requesting the transfer and registration of the aforesaid licence in the State of Uttarakhand. 3. A report was called on 16.08.2024 from the District Magistrate of Tinsukia, State of Assam. The District 1 2026:UHC:2793 Magistrate of Tinsukia, under the hand of Additional District Magistrate of Tinsukia, State of Assam has given a “No Objection Certificate” vide its letter dated 29.08.2025, annexure no.3 to the writ petition. 4. It is contended by learned counsel for the petitioner that his application dated 06.08.2024 is still pending disposal with respondent no.2-District Magistrate, Udham Singh Nagar. 5. A prayer has been made by learned counsel for the petitioner to direct the District Magistrate, Udham Singh Nagar, to decide the said application of the petitioner dated 06.08.2024, annexure no.2 to the writ petition, in accordance with law, in a time bound manner. 6. There is no opposition from the side of learned State counsel to the said proposition of learned counsel for the petitioner. 7. Accordingly writ petition stands disposed of with a direction to respondent no.2-District Magistrate, Udham Singh Nagar, to take a decision on the application of the petitioner dated 06.08.2024, annexure no.2 to the writ petition, strictly, in accordance with law, within a period of two months from the date of production of certified copy of this order.
