Despite service, no one has put appearance on their behalf. Further wait is not justifiable. The applicants have preferred the accompanying appeal, against the judgment and decree dated 03.12.2024, passed by the Court of learned District Judge, Bilaspur, District Bilaspur, H.P. Vide judgment and decree dated 03.12.2024, the learned District Judge, Bilaspur, has dismissed the appeal preferred by the applicants. Since the appeal has been filed after the prescribed period of limitation, as such, the present application for condonation of delay has been moved. The delay has mainly been sought to be condoned on the ground that after the decision of the appeal, by the learned District Judge, Bilaspur, District Bilaspur, H.P., the matter has to be dealt with, at various stages and due to those administrative exigencies, the appeal could not be filed, within the prescribed period of limitation. The application is duly supported, by the affidavit of Superintending Engineer, 10th Circle, H.P.P.W.D., Bilaspur, District Bilaspur, H.P. Despite issuance of the notices to the respondents, they have not opted to put appearance to contest/controvert the factual position, as mentioned, in the application. Considering the fact that the stand of the applicants remained uncontroverted, the application under consideration is allowed and the delay in filing the appeal is ordered to be condoned.
