Hussain, learned Counsel for the petitioner and Mr MP Goswami, learned Additional Public Prosecutor appearing for the State. By this application, the petitioner has sought for bail in connection with Sorbhog P.S. Case No. 09/2026 registered under Section 20(b)(ii)(B) of NDPS Act. The FIR dated 02.02.2026 reveals that on an information received that one Page No.# 2/2 person is loitering with some narcotic drugs ganja at a particular area, the police personnel after completion of the necessary requirements reached that particular placen apprehended the petitioner and on search being made at his house, they recovered one white colour polythene containing ganja from his house and the total weight of the said contraband was 1.5 kgs. Mr. M.I. Hussain, learned Counsel for the petitioner submits that the petitioner was inside the jail for 38 days and the ganja recovered from his house was also of a meager amount i.e. 1.5 kg. Mr MP Goswami, learned Additional Public Prosecutor appearing for the State, however, submits that the contrabands were recovered from the house of the petitioner and that the same is above the small quantity. On consideration of the submissions made, more so, due to the fact that the petitioner has been inside for more than a month, this Court deems it fit that the petitioner be released on bail on furnishing of a bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of Special Judge, Barpeta under the following conditions: i) The petitioner will appear before the Trial Court as and when call for. ii) The petitioner will not influence the witnesses connected with the case.
