Learned advocate for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 405 bottles of Eskuf cough syrup and the petitioner is in custody for four months. Learned advocate for the State opposes the prayer for bail and submits that seizure was made from the present petitioner. However, State is unable to apprise this court as to whether there is any antecedent of the present petitioner. Having considered that the petitioner is a lady and the prosecution has relied upon nine witnesses in order to prove its case, I am of the opinion that some time will be required to take the trial to its logical conclusion, as such, I am inclined to enlarge the petitioner on bail.
2 Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Krishna Sharma shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), 4th Court, Alipore, South 24 Parganas. If on bail, the petitioner shall also make herself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of South 24 Parganas without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1589 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
