In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Mukeem, who has been accused in FIR No.70 of 2025, under Sections 8 and 22 of the Narcotic Drugs and Psychotropic Substance Act, 1985 at Police Station Banbhoolpura, District Nainital.

Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter and the Applicant is languishing in jail since 08.04.2025. He further submits that there is no proper compliance of the principles laid down under Sections 50, 52A and 57 of the NDPS Act, and therefore, the recovery is doubtful. Learned counsel representing the Applicant further submits that the co- accused Riyasat Hussain @ Anduwa, has been granted default bail by the learned Trial Court vide order dated 21.07.2025.
5. Bail application of the Applicant has been vehemently objected by the learned State Counsel on the ground that the mandatory provisions of the NDPS Act so attracts in the present case were fully complied with by the Police Party. Learned State Counsel further submits that the Applicant has
committed a very serious offence, hence does not deserve for bail and if the Applicant be released on bail then he will misuse the same and will abscond.
6. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
7. Accordingly, bail application is allowed. It is directed that the Applicant - Mukeem, who has been accused in FIR No.70 of 2025, under Sections 8 and 22 of the Narcotic Drugs and Psychotropic Substance Act, 1985 at Police Station Banbhoolpura, District Nainital, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
