By filing the present petition, the petitioner has called in question the inaction on the part of the District Magistrate, Raipur, in not considering and deciding the petitioner's application under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, ‘SARFAESI Act’), registered as Case No.87/ब-121/25-26, seeking assistance for taking over possession of the secured assets, and has prayed for a limited direction for expeditious disposal of the said application. The petitioner has prayed for the following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to direct the District Magistrate, Raipur to decide the pending application under section 14 of SARFAESI Act, 2002 registered as 87/ब-121/25-26 in a suitable time frame in accordance with law. 10.2 Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioner, in the facts and circumstances of the present case, in the interest of justice.” 2. Learned counsel for the petitioner submits that the petitioner has confined the prayer in the present petition to a limited direction that the pending application under Section 14 of the SARFAESI 3 Act, 2002, filed before the District Magistrate, Raipur, may kindly be considered and decided within a time-bound period in accordance with law. 3. Learned State counsel submits that he has no objection to the limited prayer made by learned counsel for the petitioner. 4. Having considered the submissions made by learned counsel for the parties and the limited prayer made in the present petition, the concerned respondent authority is directed to consider and decide the petitioner's pending application under Section 14 of the SARFAESI Act, 2002, expeditiously, preferably within a period of 30 days from the date of receipt of a certified copy of this order, in accordance with law. 5. It is made clear that this Court has not expressed any opinion on the merits of the pending application, and the competent authority shall decide the same strictly in accordance with law and on its own merits. 6.
