Accused no.2 in Crime No.185 of 2026 registered by Gowribidanur Rural Police Station, Chikkaballapura District for offences punishable under Sections 9, 39, 50, 51(1) of Wildlife (Protection) Act, 1972 and Sections 3, 25(1)(a) of Indian Arms (Amendment) Act, 2019 is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.185 of 2026 was registered by Gowribidanur Rural Police Station, Chikkaballapura District for the aforesaid offences against Sri Boya Shekara and others, based on the first information dated 31.05.2026, received from Sri Hareesh kumar D, Police officer attached to Gowribidanur Rural Police Station. In the said case, petitioner was arrested on 31.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.284 of 2026 was rejected on 17.06.2026. Therefore, he is before this Court. 4. In the first information submitted on 31.05.2026 by the police officer attached to Gowribidanur Rural Police Station, - 3 - HC-KAR CNR: KAHC010422072026 NC: 2026:KHC:40150 CRL.P No. 8916 of 2026 it is stated that, based on credible information received that some persons had hunted a wild animal near a government lake at Chigatagere Village, the Vehicle bearing registration No.AP-39-TK-3418 was intercepted and it was found that, the inmates of the said vehicle were transporting the carcass of a wild boar. The said persons were also in possession of an unlicensed gun, which was allegedly used for the purpose of hunting the wild boar. On enquiry, the inmates of the vehicle informed that petitioner was the person who had shot dead the wild boar for the purpose of its meat. It is under these circumstances, accused nos.1 to 7 named in the FIR were arrested and remanded to judicial custody. 5. Except the petitioner herein, all the other accused persons have been granted regular bail in the present case by the jurisdiction of Sessions Court in Crl.Misc.No.283 of 2026 disposed of on 17.06.2026. Petitioner, who has no other criminal antecedents, is in custody for the last two months. Major portion of the investigation is already completed. The alleged offences are not punishable with life imprisonment or death sentence. The petitioner is directed to be enlarged on bail in Crime No.185 of 2026 registered by Gowribidanur Rural Police Station, Chikkaballapura District for offences punishable under Sections 9, 39, 50, 51(1) of Wildlife (Protection) Act, 1972 and Sections 3, 25(1)(a) of Indian Arms (Amendment) Act, 2019, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of - 5 - HC-KAR CNR: KAHC010422072026 NC: 2026:KHC:40150 CRL.P No. 8916 of 2026 the said Court until the case registered against him is disposed off.
