1. It transpires that the defect pointed out by the Registry is that the applicant has not :led a separate application seeking the relief of temporary bail along with the present application. However, it is apparent from the prayer made in the present application that the same has been :led speci:cally seeking the relief of temporary bail to the present applicant for limited period. Therefore, the relief of temporary bail itself is the subject matter of the present application, and no separate application seeking temporary bail is required to be :led.

This is the second bail application :led under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 608/2026 registered at Police Station – Sarkanda, District- Bilaspur (C.G.) for the o?ence punishable under Sections 296, 115(2), 351(3), 118(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS).
3. The earlier bail application of the applicant being MCRC No. 7209 of 2026 was rejected by this Court vide order dated 06.08.2026 on merits.

Learned Counsel for the applicant submits that without entering into the merits of the case, the present application has been :led for seeking grant of temporary bail. It is submitted that the applicant’s grandfather, namely Anuj Ram Pali, passed away on 06.08.2026, and the 10th-day ceremony and 13th-day ceremony are scheduled to be held on 15.08.2026 and 18.08.2026, respectively. It is further submitted that, being the grandson of the deceased, the applicant is required and desirous of attending the aforesaid ceremonies and performing the customary rites in connection with the demise of his grandfather. In support thereof, a copy of the condolence letter along with the Police Memo has been :led collectively as Annexure A/4. He, therefore, prays that the applicant may kindly be granted temporary bail for a limited period to enable him to attend the aforesaid ceremonies.
5. Per contra, learned State counsel, upon veri:cation of the facts stated by learned counsel for the applicant regarding the demise of the applicant’s grandfather and the ceremonies scheduled to be
3 held on 15.08.2026 and 18.08.2026, submits that the aforesaid
facts have been duly veri:ed. He further submits that, in view of the circumstances stated above, he do not oppose the prayer for grant of temporary bail to the applicant for a limited period.

Having considered the submissions made by learned counsel for the applicant and learned State counsel, and having regard to the fact that the applicant’s grandfather, namely Anuj Ram Pali, passed away on 06.08.2026 and that the 13th-day ceremony is scheduled to be held on 18.08.2026, which fact has also been duly veri:ed by the State, this Court is of the considered view that, in the interest of justice, the applicant may be permitted to attend the said ceremony under police custody instead of granting temporary bail. Accordingly, it is directed that :- (i) The applicant, namely Raj Pali, who has been arrested in connection with Crime No. 608/2026 registered at Police Station Sarkanda, District Bilaspur (C.G.), for the o?ences punishable under Sections 296, 115(2), 351(3), 118(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS), shall be taken under proper police custody to the place of the 13th-day ceremony of his deceased grandfather on 18.08.2026, for the limited purpose of attending the said ceremony. (ii) The Superintendent of Police, District Bilaspur, as well as the Superintendent of the concerned Jail, shall ensure that the applicant is taken under proper police custody on 18.08.2026 for attending the aforesaid ceremony and is thereafter brought back to the concerned jail.
4 (iii) The applicant shall remain under constant police custody during the entire period he remains outside the jail on 18.08.2026 and shall not be permitted to leave the place of the ceremony for any other purpose. (iv) Immediately upon completion of the aforesaid ceremony, the applicant shall be brought back and produced before the concerned Magistrate on 19.08.2026, who shall pass appropriate orders for sending him back to the concerned jail where he is presently lodged, without any delay. (v) The Superintendent of Police, District Bilaspur, and the Superintendent of the concerned Jail shall make all necessary arrangements for the safe transportation and escort of the applicant and shall ensure his return to the concerned jail on
19.08.2026.
7. With the aforesaid directions, the present application :led by the applicant for seeking grant of temporary bail stands disposed of.
8. The Registrar (Judicial) is directed to communicate a copy of this
order forthwith to the concerned trial Court, the Superintendent of the concerned Jail and the Superintendent of Police, District Bilaspur, for necessary information and compliance. Sd/- (Ramesh Sinha)
