Majidul Sk &Anr. … Petitioner(s) Mr. Arup Kumar Bhowmick … for the petitioner(s) Mr. Sagar Saha Ms. Nayana Mukhopadhyay … for the State-respondent(s) Learned advocate for the petitioners at the inception submits that the petitioner no.1 has already been arrested, as such, his prayer for anticipatory bail be withdrawn. In view of the submissions advanced, the prayer for anticipatory bail of the petitioner no.1 is dismissed as not pressed. So far as the petitioner no.2 is concerned, learned advocate for the State is asked whether there is any previous antecedents and/or call data records and money trail is available. Learned advocate for the State, on perusal of the Memo of evidence submits that there are no such materials 2 appearing against the petitioner no.2 and he has been implicated only on the basis of statement of the co-accused. Having considered the same, I am of the opinion that custodial detention of the petitioner no.2 is unwarranted. Hence, the prayer for anticipatory bail of the petitioner no.2 is Allowed. Accordingly, I direct that in the event of arrest, the petitioner no.2 [Kajimul Sk @ Md. Kajimul Sk] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 2574 of 2026 is disposed of.
