Hon’ble Pankaj Purohit, J. Mr. Sandeep Kothari, learned counsel for the petitioner. 2. Mr. Pradeep Hairiya, learned Standing Counsel for the State. 3. Petitioner was serving as Assistant Excise Commissioner under the State Government. Vide order dated 12.06.2025 (wrongly mentioned as 12.05.2025), punishment of reversion to the post of Excise Inspector was imposed upon him. Thus, feeling aggrieved, petitioner has approached this Court. 4. Learned State Counsel, however, submits that writ petition would not be maintainable as petitioner has a statutory remedy under U.P. Public Service (Tribunals) Act, 1976. 5. Learned counsel for the petitioner does not dispute the said submission. However, he submits that there is no factual controversy involved in the writ petition and the writ petition can be decided without going into factual issues. 6. This Court is not impressed with the submission made by learned counsel for the petitioner. 7. Since petitioner has a statutory remedy under U.P. Public Service (Tribunals) Act, 1976, this Court is not inclined to entertain the writ petition. 8. Writ petition is accordingly dismissed on the 2026:UHC:2660-DB ground of alternate remedy available to him. We, therefore, transfer this writ petition along with entire record to Public Services Tribunal. 9. Registry shall do the needful by replacing the record of writ petition with a photocopy thereof to be supplied by learned counsel for the petitioner. (Pankaj Purohit, J.)
